The objective and purpose of this paper is to provide an overview of the credit derivatives market and to analyse some of the legal and documentation issues found in the market. Where legal issues are concerned, this paper is written mainly based on English law, as it is the most widely used law in Asia and the laws of other jurisdictions where applicable. On issues concerning the International Swaps and Derivatives Associations' standard documentations, New York law applies. There will also be a section focusing on the practical aspects of negotiating credit derivative terms.
